1. Scope of Service and Legal Status
NextModel.lk operates as an online talent discovery platform that facilitates connections between Models/Actors (Candidates) and prospective employers (Clients).
- Status: We are NOT an exclusive management agency but a marketplace service provider. Our obligations are limited to platform maintenance and facilitating introductions.
2. Membership, Term, and Fees
- Registration Fee: All Candidates must pay a non-refundable registration fee of LKR 15,000 (Sri Lankan Rupees Fifteen Thousand) inclusive Taxes to activate their portfolio. This fee covers administrative costs and is NOT contingent upon securing work or bookings.
- Term and Renewal: Membership is valid for one (1) calendar year from the activation date. Annual renewal requires payment of LKR 8,000 (Eight Thousand Sri Lankan Rupees) inclusive of all applicable taxes.
- Withdrawal/Refunds: The registration and renewal fees are strictly non-refundable. Candidates who request portfolio removal in writing before the term expires forfeit all remaining membership time and fees.
3. Minors, Liability, and Compliance
A. Registration of Minors (Under 18)
- Registration for minors MUST be completed by a parent or legal guardian (“Guardian”). The Guardian assumes full legal responsibility for all actions and content related to the minor’s profile.
- The minor’s public profile will display the Guardian’s contact details for all client communication.
B. Verification and Compliance
- Verification: NextModel.lk reserves the right to request documentation (e.g., birth certificate, legal identification) to verify the relationship between the Guardian and the minor. Failure to provide verification upon request may lead to immediate suspension of membership without refund.
- School/Institutional Compliance: The Guardian is solely liable and responsible for ensuring the minor’s participation and profile publication does not violate any regulations set by their school or educational institution. NextModel.lk accepts no liability for issues arising from institutional non-compliance.
4. Limitation of Liability and Indemnity
A. Post-Introduction Liability
- If a Candidate (or Guardian) grants explicit written approval to share direct contact details with a specific Client, all subsequent negotiations, contracts, payments, and services rendered are conducted solely between the Candidate/Guardian and the Client.
- NextModel.lk is NOT liable for any payments, fees, damages, contractual disputes, breach of agreements, or personal issues arising after the authorized introduction. Candidates/Guardians acknowledge and agree that NextModel.lk is exempt from any such liability.
B. Content and Publication
- Candidates/Guardians grant NextModel.lk a license to publish approved media and portfolio information on the site.
- Waiver of Claims: Candidates/Guardians agree to indemnify and hold harmless NextModel.lk against any claims, damages, or insults related to the authorized publication of their photos and videos on NextModel.lk’s website and social media platforms.
C. Governing Law
- These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
